Scope of Job Hob’s Privacy Policy

  • This policy covers how JobHob treats personal information that is collected and received, including information related to your past use of JobHob products and services. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.
  • This policy does not apply to the practices of companies that JobHob does not own or control, or to people that JobHob does not employ or manage.

Use and Collection of Information

  • JobHob collects personal information when you register with JobHob, when you use  JobHob products or services, when you visit JobHob pages or the pages of certain JobHob partners, and when you enter promotions or sweepstakes. JobHob may combine information about you that we have with information we obtain from business partners or other companies.
  • When you register we ask for information such as your name, email address, birth date, gender, zip code, occupation, industry, and personal interests. For some financial products and services we may also ask for additional information like your address. Once you register with JobHob and sign in to our services, you are not anonymous to us.
  • JobHob collects information about your transactions with us and with some of our business partners, including information about your use of our products and JobHob automatically receives and records information on our server logs from your browser, including your IP address, JobHob cookie information, and the page you request.
  • JobHob uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients.

      Children

  • Children under 18 are not allowed to register to JobHob. You have to be at least 18 to be able to register.

Information Sharing and Disclosure

  • JobHob does not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide products or services you've requested, when we have your permission, or under the following circumstances:
    • We provide the information to trusted partners who work on behalf of or with JobHob under confidentiality agreements. These companies may use your personal information to help JobHob communicate with you about offers from JobHob and our marketing partners. However, these companies do not have any independent right to share this information.
    • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
    • We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of JobHob’s terms of use, or as otherwise required by law.
    • We transfer information about you if JobHob is acquired by or merged with another company. In this event, JobHob will notify you before information about you is transferred and becomes subject to a different privacy policy.
  • JobHob displays targeted advertisements based on personal information. Advertisers (including ad serving companies) may assume that people who interact with, view, or click on targeted ads meet the targeting criteria - for example, women ages 18-24 from a particular geographic area.
    • JobHob does not provide any personal information to the advertiser when you interact with or view a targeted ad. However, by interacting with or viewing an ad you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad.
    • JobHob advertisers may include companies belonging to any industry, sector or geographic region.
  • JobHob works with vendors, partners, advertisers, and other service providers in different industries and categories of business. For more information regarding providers of products or services that you've requested please read our detailed reference links.

Cookies

  • JobHob may set and access JobHob cookies on your computer.
  • JobHob lets other companies that show advertisements on some of our pages set and access their cookies on your computer. Other companies' use of their cookies is subject to their own privacy policies, not this one. Advertisers or other companies do not have access to JobHob's cookies.
  • JobHob uses web beacons to access JobHob cookies inside and outside our network of web sites and in connection with JobHob products and services.
  • You can edit your JobHob Account Information at any time.
  • We reserve the right to send you certain communications relating to the JobHob service, such as service announcements, administrative messages etc, that are considered part of your JobHob account, without offering you the opportunity to opt-out of receiving them.
  • You can delete your JobHob account anytime. Your information will be instantly deleted after you cancel your account. Only your name, address and e mail will remain in our system for our record purposes.

Confidentiality and Security

  • We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.
  • We have physical, electronic, and procedural safeguards that comply with federal regulations to protect personal information about you.

Changes to this Privacy Policy

  • JobHob may update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your JobHob account or by placing a prominent notice on our site.

JobHob has no responsibility for content on other web sites that you may find or access when using JobHob’s products or services. Material available on or through other web sites may be protected by copyright and the intellectual property laws of the United States and/or other countries. The terms of use of those web sites, and not the JobHob Terms of Service, govern your use of that material.

This Privacy Statement sets forth the online data collection and usage policies and practices that apply to the JobHob Web Sites and does not apply to information we collect in any other fashion.

Your data will be stored and processed in whole or in part by us. The information we gather on the JobHob Sites may be shared within JobHob on a worldwide basis in order to deliver the products and services we offer to employers such as searches for job seekers or in order to undertake analysis of our database such as aggregate profiling of our registered users.
The JobHob site contains links to other Web sites over which we have no control. We are not responsible for the privacy policies or practices of other Web sites to which you choose to link from our Sites. We encourage you to review the privacy policies of those other Web sites so you can understand how they collect, use and share your information.


Collection and Use of Information by JobHob
In some areas of JobHob, we request or may request that you provide personal information, including your name, address, e-mail address, telephone number credit card number, social security number, contact information, billing information and any other information from which your identity is discernible. In other areas, we collect or may collect demographic information that is not unique to you such as your ZIP code, age, preferences, gender, interests and favorites. Sometimes we collect or may collect a combination of the two types of information. Examples of areas on the JobHob where we collect personal or combined personal and demographic data are pages where you can use JobHob premium services like salary survey or personal interview tips.
In addition, we may indirectly collect information about you when you use certain third party services available on JobHob. For example, if you register on JobHob by using your university e mail address you authorize us to store your school e mail; such information will be subject to, and treated in accordance with, the policies and practices described in this Privacy Statement.

We also gather or may gather certain information about your use of JobHob sites, such as what areas you visit and what services you access. Moreover, there is information about your computer hardware and software that is or may be collected by us. This information can include without limitation your IP address, browser type, domain names, access times and referring Web site addresses, but is not linked to your personal information.

We may sometimes afford you the opportunity to provide descriptive, cultural, behavioral, preferential and/or life style information about yourself, but it is solely up to you whether you furnish such information. If you do provide such information, you are thereby consenting to the use of that information in accordance with the policies and practices described in this Privacy Statement. For example, such information may be used for the purpose of determining your potential interest in receiving e-mail or other communications about particular products or services.

If you choose to use our referral service to tell a friend about the JobHob or refer a job posting to a friend, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the JobHob site or view the job posting. We do not store this information.
We use the information we gather on JobHob, whether personal, demographic, collective or technical, for the purpose of operating and improving the site, fostering a positive user experience, and delivering the products and services that we offer.

If you have provided consent for us to do so, we may also use the information we gather to inform you of other products or services available from us or our affiliated companies or to contact you about your opinion of current products and services or potential new products and services that may be offered.

We may use your contact information in order to send you e-mail or other communications regarding updates at the JobHob site, and if you have requested, information on new opportunities and additional job postings which may be of interest to you. The nature and frequency of these messages will vary depending upon the information we have about you.

In addition, at the time of registration for a My JobHob account, you have the option to elect to receive additional communications, information and promotions, including without limitation, free informational newsletters from us relating to topics that may be of special interest to you, such as career management advice.

We have areas on the JobHob site where you can submit feedback. Any feedback you submit in these areas becomes our property, and we can use such feedback (such as success stories) for marketing purposes or to contact you for further information.


Choices Regarding the Disclosure of Personal Information to Others
We do not disclose your personal information to third parties, or your combined personal and demographic information or information about your use of JobHob (such as the areas you visit or the services you access), except as set forth below.

  1. We disclose information to third parties if you consent to such disclosure. For example, if you indicate that you would like to receive information about the opportunities, products or services of third parties at the time you register for My JobHob account, we supply your contact information to third parties such as employers, recruiters, data aggregators, marketers or others for the purpose of sending you e-mail or otherwise communicating with you. We use data we have about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third-party.
  2. We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our Web servers, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These companies and individuals will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party.
  3. We disclose information if legally required to do so, if requested to do so by a governmental entity or if we believe in good faith that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.
  4. We disclose and transfer information to a third party who acquires all or a substantial portion of our business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event we become the subject of a bankruptcy proceeding, whether voluntary or involuntary, we or our trustee in bankruptcy may sell, license or otherwise dispose of such information in a transaction approved by the bankruptcy court. You will be notified of sale of all or a substantial portion of our business to a third party via email or through a prominent notice posted on the JobHob site.

If you have a JobHob profile, employers may access your profile, however, they will not have access to your contact information and your contact information is not displayed in any profile till the time you want them to access it.


Other Uses of Information
We also share aggregated anonymous information about visitors to JobHob with its clients, partners and other third parties so that they can understand the kinds of visitors to the JobHob site and how those visitors use it.

We supply technology, hosting and related services to other leading companies to power recruitment areas on their Web sites (sometimes referred to as "Hosted Career Sites"). Personal and/or demographic information supplied by you in Hosted Career Sites becomes part of the JobHob database, but it is not accessible by anyone other than you, JobHob and the company concerned without your consent. If you attempt to register with JobHob after registering with a Hosted Career Site, JobHob will recognize your information and you will be able to use the information you provided to the Hosted Career Site in your My jobhob account registration.

Information gathered on a page in a Hosted Career Site or on a co-branded page (such as that of a contest co-sponsored by jobhob and another company), may become the property of the other company or of both us and the other company. In that instance, the use of such information by the other company will be subject to the privacy policy of that company. We are not responsible for that company's use of your personal or demographic information.

If you apply for a position on JobHob or through a Hosted Career Site, you may be asked to provide information on your gender, race or other protected status where permitted by applicable law. Some employers are required by law to gather this information from job applicants for reporting and record-keeping requirements. You should understand that if provided, this information will be used by employers only in accordance with applicable law and will not be used in making any negative employment decisions. All information provided will be kept separate from your expression of interest in any job opportunity. Providing this information is strictly voluntary and you will not be subject to any adverse action or treatment if you choose not to provide this information.


Personal Information on Resumes and Profiles
Since JobHob is a career site, we give you three options regarding the accessibility of your resume:

  1. You can store your resume in our database, but not allow it to be searchable by potential employers. Not allowing your resume to be searchable means that you can use it to apply for a job online, but employers and recruiters will not have access to search it through our resume database product.
  2. If you allow your resume to be searchable without making it confidential and hiding your contact information, then all parties with access to our searchable resume database (or copies thereof) will have access to your resume.
  3. If you have a confidential resume, but apply to a job posting on JobHob, the employer to whom you send your resume will be able to view your contact information.

We attempt to limit access to our searchable resume database (or copies thereof) only to paying employers, recruiters, hiring managers, headhunters, and human resource professionals, as well as law enforcement and national security agencies, but cannot guarantee that other parties will not gain access to this database. We are not responsible for the use made of resumes by third parties who access such resumes while they are in our searchable database. You may remove your resume on Jobhob but, employers, recruiters and others who have paid for access to the JobHob resume database or to obtain a copy of that database or have paid for access to the JobHob premium services, as well as parties who have otherwise gained access may have retained a copy of your resume in their own files or databases. We are not responsible for the retention, use or privacy of resumes or profiles in these instances.


Posting to Public Areas of JobHob
Please remember that if you post any of your personal information in public areas of JobHob, such as in online forums or classifieds, or in the JobHob searchable resume database, such information may be collected and used by others over whom we have no control. We are not responsible for the use made by third parties of information you post or otherwise make available in public areas of JobHob.


Use of Cookies
We use "cookies" to help personalize and maximize your online experience and time online. A cookie is a text file that is placed on your hard drive by a Web page server. Cookies are not used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to your computer, and can only be read by a Web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize JobHob pages, or register for services, a cookie helps us to recall your specific information (such as user name, password and preferences). Because of our use of cookies, we can deliver faster and more accurate results and a more personalized site experience. When you return to JobHob, the information you previously provided can be retrieved, so you can easily use the features that you customized. We also use cookies to track click streams and for load balancing.

You may have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline all cookies if you prefer. Alternatively, you may be able to modify your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. If you choose to decline cookies, however, that may hinder performance and negatively impact your experience on JobHob.


Use of Web Beacons
JobHob Web pages may contain electronic images known as Web beacons (sometimes called single-pixel gifs) that allow us to count users who have visited those pages and to deliver co-branded services. Web beacons are not used to access your personally identifiable information; they are a technique we use to compile aggregated statistics about our Web site usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides.

You may not decline web beacons, however, they can be rendered ineffective by declining all cookies or modifying your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis.

Third parties are not permitted to use Web beacons on the JobHob Sites.


Access to and Modification of Your Information
You may review, correct, update or change your JobHob account information at any time.

To change your JobHob account information, simply log into your JobHob account, go to your Account Profile, review your account information and, if you wish, edit it with the options provided.
If you opted to receive newsletters, commercial e-mails or other communications from JobHob or third parties at the time you created a My joBhob account, but subsequently change your mind, you may opt-out by editing your JobHob Account as described above. If you previously opted not to receive such communications, you may later opt-in by editing your JobHob Account Profile as well.

We retain indefinitely all the information we gather about you in an effort to make your repeat use of JobHob more efficient, practical, and relevant. Of course, you can delete your resume from JobHob's online database, close your JobHob account at any time delete your JobHob profile and close your JobHob account, in which event we will remove all our copies of your resume from JobHob, your JobHob account information and remove your JobHob account information, except for an archival copy which is not accessible on the Internet.


Security of the Personal Information
We have implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes.

When you place an order online at JobHob or JobHob Networking, your credit card information is protected through the use of encryption, such as the Secure Socket Layer ("SSL") protocol. SSL makes it difficult for your credit card information to be intercepted or stolen while being transmitted. We use a service company to process its credit card transactions.


Safe Harbor
We participate in the Department of Commerce's Safe Harbor Framework arising out of the U.S. implementation of the European Union Data Protection Directive. We have certified adherence to the Safe Harbor Privacy Principles for each of the JobHob Sites. All JobHob Content is the property of the Company or its content suppliers or clients. JobHob Site Restrictions.
Users may not use any JobHob Site in order to transmit, distribute, store or destroy material, including without limitation JobHob Content, (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful.
Users are also prohibited from violating or attempting to violate the security of any JobHob Site, including, without limitation the following activities: (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to any JobHob Site, overloading, "flooding", "spamming", "mailbombing" or "crashing"; or (d) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.


Specific Prohibited Uses.
The job posting and resume database features of JobHob.com may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees. JobHob Networking may be used only for lawful purposes by individuals to network for personal or professional purposes with other individuals.
The Company specifically prohibits any other use of JobHob.com, and all Users agree not to do any of the following: (a) post any jobs on any JobHob Site for any competitor of JobHob or posting jobs or other content that contains links to any site competitive with JobHob; (b) post jobs or content on any JobHob Site that contain any hyperlinks, "hidden" keywords or any keywords that are irrelevant to the job or are otherwise misleading contained in a job posting are prohibited; post jobs for modeling or talent or talent scouting positions; (c) use any JobHob Site Resume Database for any purpose other than as an employer seeking employees, including but not limited to using the information in the Resume Database to sell or promote any products or services; (d) post or submit to any JobHob Site any incomplete, false or inaccurate biographical information or information which is not your own; (e) post on any JobHob Site any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (except for postings that make clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling, in which case such postings are permissible), requires recruitment of other members, sub-distributors or sub-agents; (f) send unsolicited mail or e-mail, making unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a user of any JobHob Site; (g) delete or revise any material posted by any other person or entity; (h) take any action that imposes an unreasonable or disproportionately large load on any JobHob Site's infrastructure; (i) notwithstanding anything to the contrary contained herein, use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search any JobHob Site other than the search engine and search agents available from the Company on such JobHob Site and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer); (j) attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of any JobHob Site; (k) aggregate, copy or duplicate in any manner any of the JobHob Content or information available from any JobHob Site; or (l) frame or link to any of JobHob Content or information available from any JobHob Site.


Registration Information.
When you register with any JobHob Site, You will be asked to provide the Company with certain information including, without limitation, a valid email address (your "Information"). In addition to the Terms of Use and any privacy policy applicable to any JobHob Web Site, You understand and agree that the Company may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application. The Company will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant.
The Company reserves the right to offer third party services and products to You based on the preferences that You identify in your registration and at any time thereafter; such offers may be made by the Company or by third parties. Please see the Company's Privacy Statement for further details regarding your Information.
Without limiting any of the other disclaimers of warranty set forth in these Terms of Use, JobHob does not provide or make any representation as to the quality or nature of any of the third party products or services purchased through the JobHob.com or any other JobHob Site, or any other representation, warranty or guaranty. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of the applicable class, or learning material, product or service, under the terms agreed to by the provider.


User Content and Submissions.
You are solely responsible for your JobHob Account information, content, messages or other information ("User Content") that You submit, publish or display (hereinafter, "post") on any JobHob Site or transmit to other Users. By posting User Content to any JobHob Site, You automatically grant, and You represent and warrant that You have the right to grant, to JobHob an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such User Content and to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses thereof.
By posting User Content to any public or non-public area of any JobHob Site, including message boards, forums, You grant the Company and its affiliates the loyalty-free, perpetual, irrevocable, sublicenseable (through multiple tiers), non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the User Content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content. You also warrant that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to You the right to grant the license stated above. You also permit any User to access, display, view, store and reproduce such User Content for personal use. Subject to the foregoing, the owner of such User Content placed any JobHob Site retains any and all rights that may exist in such User Content.
The Company acts as a passive conduit for the online distribution and publication of User Content and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring User Content posted by Users. However, the Company may review and delete any User Content that, in the sole judgment of JobHob, violates these Terms of Use, violates applicable law, rule or regulation, is offensive or illegal or violates the rights of, harms or threatens the safety of Users of any JobHob Site. The Company reserves the right to expel Users and prevent their further access to the JobHob Sites for violating the Terms of Use or applicable law, rule or regulation and the right to remove User Content which is in violation of the Terms of Use, abusive, illegal, or disruptive. The Company may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISPs or other suppliers.
The following is a partial list of User Content that is prohibited on the JobHob Sites. The list below is for illustration only and is not a complete list of all prohibited User Content:

  • is implicitly or explicitly offensive, such as User Content that engages in, endorses or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • harasses, incites harassment or advocates harassment of another any group or individual;
  • involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
  • promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  • promotes or endorses an illegal or unauthorized copy of another person's copyrighted work, such as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;
  • contains restricted or password only access pages, or hidden pages or images;
  • displays or links to pornographic, indecent or sexually explicit material of any kind;
  • provides or links to material that exploits people under the age of 18 in a sexual, violent or other manner, or solicits personal information from anyone under 18; or
  • provides instructional information about illegal activities or other activities prohibited by these Terms, including without limitation, making or buying illegal weapons, violating someone's privacy, or provides or creates computer viruses or pirating any media; and solicits passwords or personal identifying information from other Users;

It is also a violation of the Terms of Use, to include in any User Content submitted to JobHob information that may be interpreted as direct solicitation, advertisement or recruitment for an available job position directed to individuals seeking employment on either a full time or part time basis.
Each candidate made available through the Skilled and Hourly section of the JobHob.com has taken skills interview(s) offered by the Company. The results of each skilled and hourly candidate's skills interview are not evaluated by Company and should be evaluated by each employer based on such employer's specific criteria. The skills interview(s) are proprietary to Company and may be changed from time to time in Company's discretion. The skills interviews do not necessarily guarantee performance results or capture all criteria that may be relevant to an employer in making employment decisions. Company does not independently verify the information provided by candidates or the identity of candidates.
JobHob reserves the right in its sole discretion to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms of Use, including without limitation, removing the User Content from the JobHob Sites and/or terminating the offending User's ability to access the JobHob Sites and/or use JobHob services. The Company may take any other action with respect to User Content or User actions that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISPs or other suppliers.
The Company does not represent or guarantee the truthfulness, accuracy, or reliability of User Content or any other communications posted by Users or endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at your own risk.
The Company has no obligation to screen User Content in advance and is not responsible for screening or monitoring User Content posted by Users. If notified by a User of communications which allegedly do not conform to these Terms of Use, the Company may in its sole discretion investigate the allegation and determine whether to take any other actions whether to remove or request the removal of the User Content. The Company has no liability or responsibility to Users for performance or nonperformance of such activities.
We appreciate hearing from our Users and welcome your comments regarding our services and the JobHob Sites. Please be advised, however, that our policy does not permit us to accept or consider creative ideas, suggestions, inventions or materials other than those which we have specifically requested. While we do value your feedback on our services, please be specific in your comments regarding our services and do not submit creative ideas, inventions, suggestions, or materials. If, despite our request, You send us creative suggestions, ideas, drawings, concepts, inventions, or other information (collectively the "Submission"), the Submission shall be the property of the Company. None of the Submission shall be subject to any obligation of confidentiality on our part and we shall not be liable for any use or disclosure of any Submission. The Company shall own exclusively all now known or later discovered rights to the Submission and shall be entitled to unrestricted use of the Submission for any purpose whatsoever, commercial or otherwise, without compensation to You or any other person who submitted the Submission.


Registration and Password.
You are responsible for maintaining the confidentiality of your JobHob Account, JobHob Profile, passwords, and if You are a JobHob Premium Subscriber, your Billing Account. You shall be responsible for all uses of your Web Site registrations and passwords, whether or not authorized by You. You agree to immediately notify the Company of any unauthorized use of your MyJobHob Account.


Special Terms Applicable to MyJobHob Premium
  (a) Premium Membership. A MyJobHob Premium Member has paid for access to Premium features, along with an exclusive suite of products and content. The product offerings and pricing are subject to change for Premium membership. A User can access all the Premium features from their MyJobHob Account homepage.
  (b) Premium Products. MyJobHob Premium products are only accessible to Premium Members. The list of Premium products includes, but is not limited to, Resume Enhancements, Priority Resume Listings, Job Search Tutorials, Career Fit Indicator Test, and the ability to store five additional job search agents and five additional resumes over a Basic Membership. These product offerings are subject to change.
  (b) Premium Cancellation. A User will retain access to the Premium features provided that they continue to pay a monthly fee for this access. The User may terminate their membership as a MyJobHob Premium Member at any time, for any reason by using the online cancellation tool or clicking on the "Help" link and following the provided instructions.


Registration and Password.
You are responsible for maintaining the confidentiality of your MyJobHob Account, passwords, and if You are a MyJobHob Premium Subscriber, your Billing Account. You shall be responsible for all uses of your Web Site registrations, whether or not authorized by You. You agree to immediately notify the Company of any unauthorized use of your MyJobHob Accountpasswords, and if You are a My MyJobHob Premium Subscriber, your Billing Account.


JobHob's Liability.
JobHob.com acts as a venue for employers to post job opportunities and candidates to post resumes and does not screen or censor the listings offered. The Company is not involved in the actual transaction between employers and candidates. As a result, the Company has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings or any User Content and makes no representations about any jobs, resumes or User Content on JobHob.com.
In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through JobHob.com. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that You will use caution and common sense when using JobHob.com.
Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each User is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on JobHob.com, in the event that You have a dispute with one or more Users, You release the Company (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If You are a California resident, You waive California Civil Code d1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
JobHob.com Content may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of the JobHob website or its Content. The use of JobHob.com website and its Content is at your own risk. Changes are periodically made to JobHob.com and may be made at any time.
You acknowledge and agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on JobHob.com website. Employers are solely responsible for their postings on JobHob website. The Company is not to be considered to be an employer with respect to your use of JobHob Site and the Company shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on JobHob.com.
JobHob cannot guarantee and does not promise any specific results from use of JobHob.com. No advice or information, whether oral or written, obtained by a User from JobHob.com shall create any warranty not expressly stated herein.


Disclaimer of Warranty.
THE COMPANY DOES NOT WARRANT THAT JOBHOB SITE WILL OPERATE ERROR-FREE AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF JOBHOB WEBSITE OR ITS CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS. THE JOBHOB WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE COMPANY, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. Disclaimer of Consequential Damages.
IN NO EVENT SHALL THE COMPANY, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON JOBHOB SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE JOBHOB SITE AND ITS CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


Limitation of Liability.
MONSTER'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY MONSTER SITE OR YOUR USE OF THE MONSTER CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $100.

No Resale or Unauthorized Commercial Use.
You agree not to resell or assign your rights or obligations under these Terms of Use. You also agree not to make any unauthorized commercial use of any JobHob Site.


Indemnity.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to JobHob Site, (ii) your use of any JobHob Content, or (iii) your breach of the terms of these Terms of Use. The Company shall provide notice to You promptly of any such claim, suit, or proceeding.


General.
The Company makes no claims that the JobHob Content may be lawfully viewed or accessed outside of the United States. Access to the JobHob Content may not be legal by certain persons or in certain countries. If You access JobHob.com from outside of the United States, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms of Use are governed by the internal substantive laws of the Commonwealth of Massachusetts, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Boston, Massachusetts. If any provision of these Terms of Use are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use , which shall remain in full force and effect. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in an additional agreement, additional terms of use for areas of JobHob.com, a particular "Legal Notice," or Software License or material on particular Web pages, these Terms of Use constitute the entire agreement between You and the Company with respect to the use of JobHob.com. No changes to these Terms of Use shall be made except by a revised posting on this page.


Additional Terms of Use.
Certain areas of JobHob.com are subject to additional terms of use. By using such areas, or any part thereof, You agree to be bound by the additional terms of use applicable to such areas.


Account Termination
These Terms of Use will remain in full force and effect while You are a User of JobHob.com at any level. The Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your User Content from JobHob.com and immediate termination of your registration with or ability to access JobHob.com and/or any other services provided to You by the Company, upon any breach by You of these Terms of Use or if the Company is unable to verify or authenticate any information You submit to JobHob.com Site registration. Even after You are no longer a User of JobHob.com, certain provisions of these Terms of Use will remain in effect.
